Changes Are Coming!

As of Jan 1, 2023, the following things will go into effect:

Abolishes cash bail for almost every offense, including but not limited to:

  • Kidnapping
  • Armed robbery
  • 2nd-degree murder
  • Drug-induced homicide
  • Aggravated DUI
  • Threatening a public official
  • Aggravated fleeing

Offenders on electronic monitoring will have to be in flight for at least 24 hours before law enforcement will look for them.

They can almost drive to Alaska, before law enforcement can look for them!

It denies victim’s their constitutional rights and keep this in mind businesses and homeowners.  Officers will no longer be able to remove trespassers from your home or businesses.

Someone could decide to live in your shed and all law enforcement can do is give them a ticket!

You decide the force required to remove them and whether it’s legal or not.

When doing your grocery shopping, the child safety seat atop of the shopping cart may look convenient when not occupied by a child, may appear to be a convenient place to put one’s purse or handbag. However, we see these purses and handbags are left open, unzipped, unsecured….exposing the owner’s wallet, keys, cell phone and more (money!) The combination of easy access and distracted shoppers creates the perfect storm for thieves. You walk over to pick up a loaf of bread to see if it is seven grain and start picking up multiple loafs. You get even more distracted when you ask a store clerk where you can find other types of bread that match the diet you happen to be on, during which the crime has been committed. Your purse, wallet and/or cellphone has been taken. Ideally, bags/purses should be worn using shoulder or cross-body straps. Whether or not you are carrying your bag or storing it in a shopping cart, please consider keeping it closed…zipped.. buttoned, etc. Open purses are a bright and shiny invitation for thieves. Have a friend or family watch your purse or put it on your shoulder (the shoulder closest to where your frame of vision is.)

I am seeing more and more cases of failing to register under “CSAR” California Sex and Arson Registration. What this means, is if you have been convicted of a sex offense or an arson offense, there is a LIFETIME REQUIREMENT that you report to the Sheriff or LAPD EVERY YEAR within five days of your birthday that your address is current. There is a section of 290.013 that has been codified that defines “domicile”. A “domicile” can be any place that you stay on a regular basis. For example your girlfriend’s house! You must keep your address updated even if you are transient. Then it is every 30 days, not once a year within 5 days of your birthday. You could be facing 4 years in state prison, plus priors. For more case law information on this or to privately discuss your matter contact the Law Offices of Victoria Clemans.
